As we previously noted, Itsdagram, as an unofficial app that appears to use non-public APIs, is likely to be in violation of Instgram's terms of service. Instagram has yet to take any action against any third party Windows Phone app, but that doesn't mean it will not happen in the future. One notable change in the 1.2 release is that Itsdagram is no longer using the Instagram icon, something that was a rather blatant flagrant violation of Instgram's intellectual property, and was indefensible. Use of the API is, perhaps, a thornier issues, but it's hard to see how, without an agreement from Instagram, third party usage could be justified in a legal sense.
However, provided you are aware of the situation before purchasing the the paid for version Itsdagram, there's no real cause for complaint, at least from a consumer viewpoint.
